LINDEN LABS FILES RESPONSE TO COMPLAINT

IN ITS OFFICIAL BLOG, LINDEN LABS has just published an update on its response to a complaint lodged by Marc Bragg in the Federal District Court in Philadelphia, Pennyslvania.

(Connie McMahon originally reported on this issue in SL Newspaper 'Daily News' back on 10th June 2007).

Linden Labs denies Mr. Bragg's allegations and has asserted counterclaims on behalf of Linden Lab against Mr. Bragg for computer fraud, breach of contract, and other claims, arising from certain activity that led to his being suspended from participating in Second Life.

Mr. Bragg, a Second Life Resident under the user name “Marc Woebegone,” had sued Linden Lab and Rosedale to recover “virtual land, property and items that were in his account” when it was suspended, and for money damages and other relief.

Linden Lab stated in its answer: In his complaint, Bragg attempts to cast this as a case with broad implications about whether ‘virtual land’ – actually, access to computing resources that enable a virtual representation of land in a three-dimensional online digital ‘world’ – is subject to the laws governing real property. That is not what this case is about. It is a dispute about whether an online service may suspend a user from that service for engaging in a fraudulent scheme to obtain money, to the detriment of the service and its user community.”

In its counterclaims, Linden Lab alleged that “Bragg – who is a licensed attorney – and his confederates, knowingly and with intent to defraud, without Linden’s permission, obtained, used and altered data and computer software in a deliberate exploit to gain unauthorized access to Linden’s server software in order to manipulate and subvert Linden’s standard system for making so-called “virtual land” available to its users through its land auction system.”

Linden Lab also alleged that “The objective of Bragg’s scheme was to obtain access to ‘virtual land’ that was scheduled to be auctioned by Linden in the future and thus before it was available to any other users, and to acquire it for as little as one U.S. dollar rather than whatever winning bid (in excess of the minimum opening bid of U.S. $1,000.00) might have resulted from a legitimate auction” and that “After acquiring the ‘virtual land’ through this fraudulent scheme, Bragg intended to subdivide it, sell it to other Second Life users, and potentially obtain thousands of dollars in U.S. funds in ill-gotten profit.”

In addition, Linden Lab alleged that: “When Linden told Bragg that it had placed his account on hold pending their investigation of his activity, Bragg threatened to sue Linden, in an attempt to dissuade Linden from continuing its investigation into his fraudulent scheme. When Linden did not capitulate in response to Bragg’s threats and remove the hold on his account, he immediately retaliated by bringing suit and – incredibly – demanding that Linden refund him his “expectation interest in the profit” he hoped to gain by reselling the fraudulently-purchased ‘virtual land.’”

Use of the exploit not only harmed Linden Lab, but Second Life Residents as well, by disrupting the in-world economy. If those who used the exploit had succeeded, not only would have they profited unfairly, but they also could have sold their parcels at below-market prices and still made a profit, putting legitimate sellers at a disadvantage.

Consistent with the goals of its Community Standards and the provisions of its Terms of Service, Second Life is designed to be a safe environment where users can express themselves, be creative, and develop safe and legitimate relationships and businesses. Mr. Bragg’s use of the exploit was contrary to the goals of the Community Standards and violated the Terms of Service.

How was Linden really harmed by what Bragg did?

What Bragg did undermined the integrity of the Second Life economy. Other Residents reasonably expect that Second Life’s economic systems will work fairly and transparently. The use of the exploit undermines that expectation, and causes loss of good will among Residents. In addition, Linden was required to spend time and resources investigating and addressing the scheme, and the federal and California computer fraud laws provide that companies who are the victims of schemes like this are entitled to recover damages for those kinds of losses.

What about Bragg’s claim that Linden “stole” his money and his virtual property?

In fact, the money that was in his account at the time it was suspended is still there. Linden was obliged to mitigate any losses resulting from Bragg’s suspension, so instead of leaving Bragg’s “virtual land” in his account and causing him to incur monthly land use fees (or “tier charges”), Linden recovered it and auctioned it off to other users, in accordance with the Terms of Service. Now that it has been determined that the case will be decided in federal court rather than in arbitration, Linden has asked the court to hold the funds that were in Bragg’s account at the time it was suspended and the proceeds from the sale of the “virtual land” in that account, pending resolution of the dispute.

Why didn’t Linden return Bragg’s money and the proceeds from the sale of his property when he was suspended?

Bragg filed suit the very day after his account was suspended due to the irregular auction activity in his account. At that point the parties were in a legal dispute. The court will decide what happens to the money and the proceeds.

Because this dispute is still in progress, we will be offering no further comments at this time.

The end of audio streams in SL?


Yesterday (Tuesday June 26th) you might have gottan a partial taste of how it could be in the future. A lot of audio streamers, aka internet radio stations, went offline on purpose, to protest against the latest plans of the American Copyright Royalty Board (CRB), which will put most of them out of business.

Organized in the SaveNetRadio organization, they are fighting injustice, as they see it, and call on people to contact the American Congress to stop this crazy act. The Congress is the only institute that can stop this and so far they have received half a million emails and phone calls. Yet they are doing nothing.

Let me explain what this is about ...
Currently, audio streamers (aka internet radio stations) have to pay a royalty fee of about 8/100 of a (US$) penny per song. That doesn't seem much. Only L$ 0.21 per song. Almost a freebie. However, the rates will be increased up to 19/100 of a (US$) penny per song. This is an increase of 137%. This all still doesn't sound all that bad.

However, if you calculate what this would mean ...
Based on about 18 songs per hour (for non-stop radio stations and audio streams), this would mean L$ 220 per day, or L$ 6600 per month, or almost L$ 80,000 per year. This equals almost US$ 300 per year. However, this new ruling includeds an annual minimum charge of US$ 500 (or L$ 133,000) per year, no matter how many songs you play. And since 18-20 songs is kind of the maximum per hour, it is absolutely absurd to think that a station would even get over that minimum rate of L$ 133,000.

So, to operate any radio station or audio stream in SL (doesn't matter whether it's nonstop or not), it will cost you that staggering amount of L$ 133,000 per month.

And if that wasn't even enough ...
This new system will come into effect on July 15th 2007, calculating backwards to January 1st 2006. So, every radio station would have to pay about US$ 770 (or L$ 205,000) at once, and after that the annual fee.

Since it is very hard to get advertisement for the small time radio stations, this would certainly mean that they would have to stop. And the big time audio stream operators usually have many streams going on (sometimes up to 100), they would have to pay these fees for every station. Do the math!

In short ...
The sheer amount of audio streams and radio stations that can be used in Second Life by private residents, but also by DJ's for hire, by clubs/pubs/bars, they will be reduced to only a few commercial stations who can afford these royalty fees.

To top it off ...
Just to compare this with other kinds of broadcasting and radio .. normal old-fashioned broadcasting radio does not pay these royalty fees. They are exempt. Sattelite radio stations currently pay about half the fees that internet streams have to pay. And that is excluding the new plans, which only affect those internet streams !!

Introducing Baron DeSantis

Museum of Avatar Art

On a group of small islands, far far away (at least from my 'home' location), there exists a land of wonders. Some small, others large and a few 'wow' is size. Land based in part, others occupy space in the watery depths, all are the result of time, effort and skill by the creators.

Where to find this world? Well you could teleport to Xe and plunge into the depths as I did. However, to get the full benefit and enjoyment, teleport to The Museum of Avatar Art.
On arrival you will find a B&W torso sporting a bright red apple for a head!! (Turn on your speakers/music)
Close by, you have the chance to grab a note card and HUD. Following the little blue arrow signs will take you to numerous sculptures until you are faced with a dilemma.. a cliff face.
Do you leap off into the void? Yes Yes Yes.. For within Neptune's realm exists a wondrous part of the exhibition.
More sculptures (some of which defy, though appear to originate from, natural forms) will intrigue you.
An underwater building houses a curious mixture of work, some of which you can alter.
On leaving through the rear exit, turn sharp right, again following the arrow signs.
This leads to the area 'par excellence' (in my humble opinion).


Due to lack of space, I cannot mention all the works/artists but this in no way decries from the high standard achieved by those I fail to mention. The few I do mention are just because I was intrigued.
"Crossed Swords In Green Marble (When will they ever learn?)" by Cheen Pitney: An amazing piece. Almost as if a 'still' from a blockbuster epic."Fallen Angel" by Starax Statosky: A fossil like image, wonderful."From Hippos Emerge (The Ghostly Bug Takes form)" by Stella Costello, intriguing.


If there is an exhibition that sets the standard for SL sculpture, this is truly it. A must see for those who wish to stroll, relax, and enjoy the art & ambient music within SL.

10/10...Oh and by the way? NO AQUALUNGS NEEDED!!

MILLION DOLLAR MAGICIAN



TUNA ODDFELLOW pulled more than a rabbit out of his hat last Thursday when he appeared in 'The Avatar's Got Talent'. As "Fish The Magish", he walked away with the competition's One Million Linden Dollar Prize.

His "grand illusion" magic act also won him a spot on the ABC's highest rating show "America's Got Talent".

While his original appearance on the SL show got him an audience of 300 people in three sims, his next appearance will be in front of 13 million and the world's press were lined up to talk! I was very gratified that his partner Shava Suntzu and Tuna were free for an interview with me.

"I am finding this whole process to be a type of magic in its own right," Tuna enthused. "I am getting used to staring at the big numbers in the corner of my screen (one million linden dollars is equivalent to $3,800 US) "Is this how you win the game?" he asked jokingly.

"The night of the win, I got sore cheeks from smiling so hard, I swear!" added Shava.

"I've been doing magic since I was five years old," began Tuna. "My grandmother took me to see "The Magic Show", a musical with Doug Henning and I was hooked! It was in the 'grand illusion' style, the old Vegas style, cutting the beautiful assistant in half and charring her to ash and reviving her.

Tuna's own style now shows his unique brand of creativity which contain the fantastic, horror, fantasy, science fiction and sometimes stories about motivation and combining them with haunting, ethereal music.

"I really like magic that tells stories," he continued. "I don't want to just go, 'I can do this impossible thing that I can do and you can't."

"It's about taking someone down this path, where you put them in a magical space and transform them by the time they get to the other side."

Tuna explained that Tuna wrote the routines for his shows, did the choreography, both as choreography or script in the traditional sense and gestures in the SL sense. He also uses a lot of technology and devices that are either on the market for everyone, or that he commissions for himself or is given as gifts from friends - such as Loki Clifton, Mickeywishes Au and others. His favourite costumer is the renowned Vindi Vindaloo.

She pointed out that for Tuna, it was the narrative art that was important. "I'm a storyteller too," she explained, "and sometimes we perform together." "What we have together is a partnership in mind, body and spirit. We're best friends and co-conspirators Tuna is the first person who has matched me for imagination.

When I speculated that their partnership inspired them to greatness, Shava observed, "I don't know about 'greatness', greatness is just a side effect of chasing your passions I think."

Tuna reflected, "I'm being talked about in the media as a mixed reality magician and that's really what I am. I do this magic in real life and IRL I touch audiences all over the United States. Now I'll have an audience of 13 million, I can't even wrap my brain around that."

The couple plan to use the prizemoney on their consulting group "Indigenis" (Native Intelligence for Virtual Worlds) and their magic promotion IRL. "Mostly we are fueling first life dreams," said Tuna, " but I would love a sim when it makes sense."

"We're planning to do not only SL, but also Massive Multiplayer Online Role-Playing Games (MMORPG) and social networking communities."

At his magic show for the SL4B celebrations at the Globe Theatre, there was some good-natured ribbing about the tip jar (which is part of Tuna's set up for all his shows), being on the stage.

"A tip jar!" exclaimed Lauren Weyland. "You've got to be kidding. The last tip was 1,000,000L - that's enough!" "I gave him a buck," said RacerX Gullwing." "Well I tried to take 50 from him," retorted Lauren.

Fish The Magish's show which he opened with the words, "Ladies and Gentleman, I am Fish The Magish, here to amaze and amuse, dazzle and confuse was a spectacular one, of crashing trees, colour flashes, disappearing into the floor, devil skeletons, acrobatics and eerie effects - a transporation for the audience.

This was enhanced by the expert camera manipulations of Ina Centaur, which led the audience's eyes to pivotal spots on the stage for maximum effect.

After the show there was more philsophical bantering with Lauren Weyland again quipping, "You know what Descartes would say if he was here today? "I think therefore I digitize."

Not to be outdone, IntLibber Brautigan quipped, "Nah, Descartes would say, "I think, therefore I RAM."

[12:35] Philip Linden shouts: But looking at the world today, it is just as magical, only bigger.

[12:38] Philip Linden shouts: That is what makes me happiest today, and keeps me loving my job!

It has been announced that Second Life's Fourth Birthday (SL4B) will be held on June 23rd 2007 to celebrate the four years since Second Life (SL) was opened to the public.

This acclaimed 3D world will be launching this event at noon(slt) on the 23rd and running until the 30th it promises to be an event not to be missed!

Residents will be banding together to put together a memorable week long celebration that will be the largest SL has ever had for a birthday event.
SL4B is free for all to attend and should be a good representation of what everyday life is like in SL.
Just like the past 3-years of celebrations, the SL4B is going to be full of fun and excitement.

Amsterdam sold ... at last !!

The virtual version of Amsterdam has been sold ... at last !! Or should I say, again.


Last march, the owner of this landmark on the grid, Stroker Serpentine put up his very life-like version of this Dutch city for sale on eBay. Not huge news, except that the bid ended on March 26th at a staggering US$ 50,000.

But, only 2 months later, it came out that the sale was cancelled. The buyer couldn't live with the fact that he wouldn't own the intellectual rights to the design of the city. At that time, there was another bidder who came in too late and was not able to grab hold of Amsterdam. This bidder was the Dutch Arnhem-based company 3dutch and now it seems that they have come to an agreement anyway.

3dutch is a company that already provides various services for real life companies who want to enter SL in a professional way. So they do have experience with SL and doing business in this metaverse, and they seem to be in it for the long term. Today they were not available for comments (either in RL or SL), so we talked to the creator and seller of this city. He was bound by a non-disclosure agreement about details of the sale (including the price), but it seems that he has gotten himself a pretty good deal. We talked to him about it.

Dixie Barbosa: I am curious if you will still be involved with Amsterdam (and maybe the Eros sims). For design, maintenance, management or whatever.

Stroker Serpentine: We have an excellent relationship with 3Dutch. I am looking forward to collaberating with them on an ongoing basis. We intend to get them up and running as quickly as possible with events and exciting new features. Since they are a Dutch Company they have a unique perspective on what their countrymen (and women) find attractive.

Dixie Barbosa: as i've understood, you're not dutch yourself. what drove you to build a virtual version of Amsterdam in the first place?

Stroker Serpentine: As a tribute to my SexGen Partner Briggi Bard...who lives there in real life. Not to mention it is the Sexiest City in the world (in my opinion)

Dixie Barbosa: I bet you are a very busy man at the moment. One more question. What are your future plans? Will you be doing more building jobs similar to the Amsterdam sim?

Stroker Serpentine: Well, 3Dutch will add the touches that will make Amsterdam a complete immersive version. I have been told that the phonebooths I made were English...they were the first thing to be redone :)


All in all it seems that Amsterdam might get even more commercial in the future and will have more RL company presence, since that is the core business. And to what Mr. Serpentine got out of it? I bet nobody will ever know. But considering the issue that the sale went sour over before (copyrights etc), and the future collaboration between the old sim owner and the new one, I bet he will be doing very well in the future. He closed our conversation with the words ...

Miralee's Latest Adventure - An Epic Couch Adventure!



I'LL LET YOU INTO A LITTLE SECRET READERS, my landing spot, when I first log on to Second Life, is a little underwater hidey-hole I have somewhere in Kissling.

So this morning, I landed as normal and was just standing there (underwater), minding my own business - doing a bit of tidy up work before I headed into work at the SL Newspaper, when with my screen obscured by windows, I heard the sound of typing!

"Hey? What's somebody doing down here?" I thought to myself. When I cleared my screens I was surrounded by three cute-as-a-button furry creatures - Vekk Sonic, Wereblood Eliot and Faz McKenna.

The trio, who were on an Epic Couch Adventure, and who had crash-landed into the same water body that I had originally crashed into, very kindly asked me to join them on their epic adventure.

"Write about how parcels with no scripts ruin our adventures," asked Faz. (Mental note to self - okay, do that).

They righted the couch out of the water, I climbed aboard and we were off! Apparently the dress I was wearing - made by the wonderfully talented Lucinda Obviate - acted as a jet engine when we moved forward.

The trio explained that their plan was to cruise around SL world recruiting people for their cool kids crew. (Mental note to self - find out more about their cool kids crew).

When I explained that I couldn't come with them, but had to get to work, they lowered the couch and dropped me off. Lo and behold! I was in front of the Builder's Choice building which proclaimed on its billboard:

"Save Second Life - Get Involved Now - Support Bug Fixes - Demand A Stable Grid". (Mental note to self - check out these guys later!)

As they sailed away on the rest of their adventure, Faz called out, "See you later alligator!" I hope so, those guys were fun!

Meet & Greet huge succes !!


Yesterday, on Saturday June 16th, we had our first big Meet & Greet event in the lobby of our newspaper headquarters. We had been preparing this event/party for a couple of weeks and we were overwhelmed by the number of people attending and the warm feeling it brought to our hearts. It was truly an honor to welcome all those who found the time to drop in. We consider the party to be a big success and are already (in the back of our heads) thinking about the next one !!!

The main purpose of the Meet & Greet was served. It was a chance for our readers to meet and greet us, but on top of that it was also a chance to see our HQ that most of us see as our 2nd home (and some of us even first home). But ... on top of that, we also intended the party as a chance to talk to our readers and lower the threshhold to open communications and get feedback.

The party went smoothly, although there was some lag. The sim came close to crashing at one point and sometimes people had a hard time getting in ...



The party lasted for several hours and DJ Tangletwigs Fairymeadow rocked the place. The sploder went haywire and made several people very happy. And not only that .. during the party we held a lottery, combined with a small survey. Anyone submitting a survey form was joining in and the prize was L$ 5000. Today we drew the winner and paid out. Congratulations again Selina !!!

We are already thinking about organizing these Meet & Greet parties more often, to give you an opportunity to get involved, and for us a chance to meet our readers and get that valuable feedback. To give you an impression this great event though, here are some photos ...





At the end of the party, we went to the rooftop to have a little fun with our mascotte, Jiggy the Pink Elephant. We fed him some leftovers and before we knew it, he was juggling us like it was nothing ...
